1. General Terms and Conditions

These General Terms and Conditions (GTC) apply to the use of skill and casual games on the winwyz platform (hereinafter "Platform").

• “Sponsor”: Third party provider that provides prizes or supports promotions.
• “Prize”: Any prize in cash or in kind offered on the Platform or by Sponsors.
• “User”: Any natural person who registers on the Platform and participates in games or tournaments.

By registering and using the service, users accept these terms and conditions.

2. Eligibility

Only adults (at least 18 years old) are permitted to participate. By using the platform, users confirm their minimum age and legal capacity. The platform reserves the right to exclude participants if they suspect false information or non-compliance.

3. Registration and user account

Users must provide truthful and complete information upon registration. Each user is responsible for maintaining the confidentiality of their login credentials. In the event of suspected misuse, the platform reserves the right to block the account.

4. Free participation

Participation in games and tournaments is free for users. No deposits are required to participate or win real money prizes.

5. Game rules and determination of winnings

The games are skill-based. Winnings are determined according to the respective game rules and winning logic, which are based on the players' skill. Pure gambling elements are excluded.

6. Real money prizes and payout

Users can win real money prizes despite participating for free. Payouts are made after identity verification and compliance with all applicable legal regulations. The platform reserves the right to conduct an identity check. The user is required to submit a copy of a valid ID card or passport along with the payout request.

7. Prize claim and processing

a) Prizes must be claimed by the user within 7 days of the announcement. If no claim is made within this period, the claim will expire without compensation. Prize claims should be sent via email to gewinn@winwyz.games.

8. Profits and availability

The platform is not liable for winnings or potential winnings, even in the event of an abandoned game, duel, or tournament. Should a game end prematurely for technical reasons beyond the control of the platform, the last determined score will apply.

9. Fair play and protection against manipulation

Users are committed to fair play. Manipulation, multiple registrations, or other unfair practices will result in immediate exclusion and forfeiture of winnings. Suspicious activity may be investigated, and accounts may be blocked.

10. Data protection

The platform processes personal data in accordance with the privacy policy, which is an integral part of these Terms and Conditions. Users consent to the storage and processing of their data for the purpose of participation and prize processing.

11. Data use and transfer to sponsors

The user agrees that his or her personal data may be shared with selected sponsors and partners, if necessary. This will be done exclusively within the framework of applicable data protection regulations. An objection is possible at any time, provided there are no statutory retention periods to the contrary.

12. Taxes and duties

The user is solely responsible for the proper taxation of winnings. The platform assumes no liability for this.

13. Liability

The platform is only liable for intent and gross negligence. No liability is assumed for technical malfunctions, delays, or other circumstances beyond the control of the platform.

14. Assignment and transferability

Claims to prizes are personal and non-transferable. Assignment to third parties is excluded.

15. Communication

Official communications will be sent via email. Users are required to provide a valid email address and to notify us of any changes immediately.

16. Changes to the Terms and Conditions

The platform reserves the right to change these Terms and Conditions at any time. Changes will be announced in a timely manner. Continued use will be deemed acceptance.

17. Termination and blocking

The platform may terminate the user relationship or block users at any time without giving reasons, particularly in the event of violations of the Terms and Conditions.

18. Applicable law and place of jurisdiction

The laws of the Republic of Austria apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction, to the extent permissible, is the registered office of the platform.

19. Miscellaneous

Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
